1. How to Enter: NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. VOID WHERE PROHIBITED. The Great American Country ("GAC") "GAC Guitar Giveaway" (the "Sweepstakes") will be conducted in 3 installments (each an "Entry Period") during the telecasts of the "CMA Music Fest" television special on the GAC network as follows: 9:00 p.m. (Eastern Time ["ET"]) on Saturday, November 7, 2009 to 12:00 a.m. ET on Sunday, November 8, 2009; (ii) 1:00 a.m. ET on Sunday, November 8, 2009 to 4:00 a.m. ET on Sunday, November 8, 2009; (iii) 5:00 p.m. ET on Sunday, November 8, 2009 to 8:00 p.m. on Sunday, November 8, 2009. You may enter the Sweepstakes by viewing the "CMA Music Fest" television special on the GAC network during each Entry Period. At nine (9) times during each Entry Period, viewers will be prompted to text the code that appears in an on-air promo and on-air pop-up graphic to the number indicated in such graphic. Standard text messaging rates apply. For more information on such rates, please contact your provider. These official rules will be available on the GAC website (www.gactv.com) (the "Website"). All entries submitted become the sole property Scripps Networks, LLC d/b/a Great American Country ("Sponsor") and will not be acknowledged or returned. Proof of submission of an entry shall not be deemed proof of receipt by Sponsor. By participating, entrants agree to be bound by these Official Rules and Sponsor’s and Sweepstakes Administrator’s decisions, which shall be final. This sweepstakes shall be governed by the privacy policy of Sponsor, which is available at the Website.
2. Eligibility: To enter the Sweepstakes, you must be a legal resident of the fifty (50) United States or the District of Columbia and be 18 years of age or older at the time of entry. Sweepstakes is void in Puerto Rico and where restricted or prohibited by law. Individuals who have won a prize from GAC and GACTV.com within 90 days (3 months) prior to November 7, 2009 are NOT eligible. Employees of Sponsor, Scripps Networks, LLC, participating product or service sponsors, their affiliated companies, parents, subsidiaries, their distributors, developers and administrators, and advertising and promotion agencies, (collectively, "Sweepstakes Entities"), and their immediate families and members of their households, are not eligible to participate in this Sweepstakes. Entries generated by robots or scripts or other automated entry are considered to be a direct violation of these Official Rules and will result in immediate disqualification of any and all associated entries.
3. Drawing and Notification: The winner will be chosen in a random drawing by Sponsor, whose decisions are final and binding in all respects. Odds of winning a prize depend on the number of eligible entries received. The potential winner will be notified by text message. If a potential winner cannot be not be reached within seven (7) calendar days from the first notification attempt and/or otherwise does not respond to Sponsor within such period, then such person may be disqualified and an alternate winner will be selected.
4. Grand Prize: One (1) Grand Prize Winner will receive one (1) autographed guitar. (Approximate Retail Value)("ARV") of the guitar is $125.
Total ARV of all prizes in the Sweepstakes is $125.
The Grand Prize is non-transferable, except as determined by Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value if a Grand Prize cannot be awarded as described for any reason. All federal, state and local taxes, if any, are the sole responsibility of the Grand Prize Winner.
5. Prize Conditions: Potential Grand Prize Winner will be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release ("Affidavit/Release"). Such documents must be returned by the date and/or time indicated within such documents. If potential winner fails to return such documents within that time, or if an entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential winner may be disqualified and an alternate winner selected. If prize or prize notification is returned as undeliverable, this will result in disqualification and an alternate winner will be selected. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the Sweepstakes Entities to use said winner’s name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.
6. Limitations of Liability: Grand Prize Winner and entrants also agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities, and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes. Sweepstakes Entities are not responsible for lost, late, misdirected, undeliverable or incomplete entries due to system errors, failures or any technical malfunctions which may limit an entrant's ability to participate. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, infection by technical difficulties, computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. The Sweepstakes Entities are not responsible for any typographical or other printing errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in the printing of posting of the offer or in these Official Rules, the selection or announcement of the winners, or the distribution of any prizes.
7. Winners List: On or about November 30, 2009, you may obtain the name of the Grand Prize Winners on the Website. After December 25, 2009, the results will be removed from the Website.
